Surrogacy is gaining ground in the world and is at the height of relevance in modern society. Statistics show that about 16% of families in the world are infertile or have problems conceiving a child. Fortunately, however, over a million children have been born with the help of modern reproductive technology. There are different opinions about surrogacy: both positive and negative. Some believe that surrogacy is the only chance for an infertile family to have their own child. Others believe that children in this case are “commodities” that can be bought by any willing couple. This is not true. The surrogate mother may be used by the couples having provided the medical certificate that they are unable to bear a child. From the legal point of view, the attitude towards surrogacy in various countries may be divided into 4 groups:

Surrogacy is allowed – Ukraine, Georgia, Kazakhstan, South Africa, the US, Russia, and India.

Only non-commercial surrogacy is allowed: Australia, Great Britain (payment of surrogate’s running costs is allowed), Denmark (with serious limitations), Israel, Spain, Canada, Netherlands, certain states of the US surrogacy is prohibited by law – Germany, Sweden, some states of the US, France not prohibited by law, but not regulated in any way – Greece, Finland.

If we “dig deeper” into the countries where surrogacy programmers are allowed, we find that in India surrogacy was very popular until one moment when the authorities of the country banned the use of women as surrogate mothers. What does this mean? The Indian government banned surrogacy for foreign couples. Only locals can use surrogacy services.

Russia is a country where surrogacy is in high demand. The disadvantage of surrogacy in Russia is that the surrogate mother may not give her consent to transfer the child to the biological parents and in principle she may keep the baby.

It is worth noting that the Ukrainian legislation is more lenient towards surrogacy. Heterosexual couples of any nationality may take advantage of the programmer. Also, biological parents are considered as legal parents of a baby born through surrogacy.
